Ogallala Board of Health
Meeting
July 20, 2004
A meeting of the Ogallala Board of Health was called to order at 7:50 P.M. by Chairman Paul Foy in the City of Ogallala Administration Building, 411 East Second Street, Ogallala, Nebraska. Members present: Dr. Paul Foy, Mary Lou Heelan, Glenn Silvius and Joe Humphrey. Absent: Dr. Kurt Johnson.
Notice of the meeting was given in advance by publication in the Keith County News, the designated method of giving notice. Notice of the meeting was delivered to members of the Board of Health by hand delivery of an Ogallala Police Officer.
Mary Lou Heelan moved to approve the minutes of the June 15, 2004 Board of Health Meeting. Humphrey seconded the motion. Voting Yes: Foy, Heelan, Silvius, and Humphrey. Voting No: None. Motion Carried
Public Forum: Dr. Foy opened the public forum and invited any individual wishing to speak to the board to come to the podium. Dr. Foy advised that the Public Forum would remain open for the duration of the public meeting.
Discussion was held pertaining to the property of 219 West 9th Street. Humphrey informed the Board of the changes to the property between July 14, 2004 and July 20, 2004. Humphrey also advised that in his opinion the property was in compliance with Municipal Code. Dayton Armstrong addressed the Board. He informed the Board of the condition of the property, repairs that have been made to the property and his plans for future work on the property. He also informed the Board that new windows have been ordered for the property.
Humphrey provided the Board with a proposed revision to the Municipal Code Ordinance 94.018 Nuisances Enumerated that was requested at the June 15, 2004 Board of Health meeting. This revision would specifically prohibits placing outdoors or exposing to the elements upholstered or overstuffed furniture with loose cushions that are not waterproof nor specifically made by the manufacture for outdoor use or exposure to the elements. Humphrey advised the Board that changes to Municipal Code would require City Council action however if the Board so chose they could recommend Municipal Code changes to the City Council.
Mary Lou Heelan moved to recommend to the Ogallala City Council to change Municipal Code 94.018 Nuisance Enumerated Section A subsection 3 to include the following wording “the placing outdoors or exposing to the elements upholstered or overstuffed furniture with loose cushions that are not waterproof nor specifically made by the manufacturer for outdoor use or exposure to the elements.” Dr. Paul Foy seconded the motion. Voting Yes: Foy, Heelan, Silvius, and Humphrey. Voting No: None. Motion Carried
Humphrey informed the Board that the next scheduled meeting, Tuesday, August 17, 2004.
Dr. Foy brought the property located at the intersection of East E and East Second Street to the attention of the Board. He expressed concern about the type of vehicles parked or left for long periods of time on the property and the weeds that grow around these vehicles. Humphrey advised that he would inspect the property and would be included on the August 17, 2004 Board of Health Agenda.
No further business to come before the Board, Humphrey moved to adjourn. Heelan seconded the motion.
Voting Yes: Foy, Heelan, Silvius, and Humphrey. Voting No: None. Motion Carried
